Equitable Caregiver

In 2019, Georgia passed a new law regarding Equitable Caregivers. The law provides a legal framework for individuals who have provided significant care and support to a child, but who are not the child’s legal parents, to seek custody or visitation rights.

Under the law, an Equitable Caregiver is defined as someone who has been the primary caregiver for a child and who has formed a “bonded and dependent relationship” with the child. This includes grandparents, aunts, uncles, and other family members, as well as non-family members such as family friends or neighbors.
